INTRODUCTION

We know that you care about how your personal information is used and shared, and we take your privacy seriously. This Privacy Policy describes how we treat personal information we have collected in connection with the application known as UP17, the website www.UP17app.com and the mobile version of the website (collectively, the “Site”), including any and all Site-related services, products and content (collectively, the “Service”). By accessing the Site or using the Service, you acknowledge that you accept the practices and policies outlined in this Privacy Policy. Your use of the Service is at all times subject to the Terms of Use, which incorporates this Privacy Policy. Any terms we use here without defining them have the definitions given to them in the Terms of Use.

OUR PRIVACY PRACTICES AND CHILDREN

In keeping with the Children’s Online Privacy Protection Act (COPPA), the law that protects children’s online privacy, we limit the collection of personal information from children under the age of 13. We screen users who wish to provide personal information in order to prevent users under the age of 13 from providing such information. Under COPPA, parents/guardians can review their child’s personal information and may also request that we no longer collect information from their child or have their child’s information deleted. This Privacy Policy explains how we collect and use information from its users, including our treatment of personally identifiable information.

HOW DO WE TREAT CHILDREN’S PERSONAL INFORMATION?

COPPA requires that online service providers obtain parental consent before they collect personally identifiable information online from children under the age of 13. Therefore, we only collect personal information through the Site from a child under 13 to obtain parental consent for that child to use the Service and disclose personal information to us.

We ask prospective users to provide their ages during the registration process. As described in the Terms of Use, if a user indicates that he or she is under the age of 13, then that user will be asked to submit the name and email address of his or her parent/guardian, which will be used for the sole purpose of providing the parent or guardian with direct notice about our privacy policies and obtaining their consent.

Users under the age of 13 are not provided with full access to the Site until we obtain verifiable parental consent by email, as described in the Terms of Use. Once we obtain verifiable parental consent, users under the age of 13 can set up their personal profiles to use the Service. We will not require a child to disclose more information than is reasonably necessary to use the Service. Parents/guardians of users under the age of 13 can view all activity and content associated with their child’s Account, including personal information.

Pursuant to COPPA, if we become aware that we have inadvertently received personally identifying information from a user under the age of 13, we will delete such information from our records. WHAT INFORMATION DO WE COLLECT FROM YOU AND YOUR CHILDREN?

  1. Information You Provide to Us

    We receive and store any information you knowingly enter on the Site, whether via computer, mobile phone, other wireless device, or that you provide to us in any other way, which may include the following:

    Children’s Information: We collect what is reasonably necessary for you to participate on our Site and use the Service. This might include, without limitation, your name, age, email address, profile picture, location, parent/guardian name and email address and other personal information in connection with your use of the Service, such as information regarding your baseball training and videos of you playing baseball.

    Parent/Guardian and Other Adults’ Information: We collect the names and email addresses of parents/guardians of users under the age of 13. We may also collect billing and payment information from parents/guardians for purchases, if any, in connection with the Service.

    Information You Submit or Upload: We collect information you submit or upload in connection with use of the Service. For example, we collect videos of you performing baseball activities that are viewed for purposes of providing pitching, hitting, fielding and other coaching and instructional feedback to you.

  2. Information Collected Automatically

    We receive and store certain types of usage information whenever you use or interact with the Service; this information is not personal information. For example, we automatically receive and record information on our server logs from your browser including your IP address, Company cookie information, and the page you requested. We also record the details of your activity on the Site, and the number and frequency of visitors to our Site and its components.

    When you download the mobile application of the Site, we automatically collect information on the type of device, name and version of the operating system, name and version of the application, the numerical mobile device user ID, as well as actions performed by you in accessing the mobile application (collectively, “Mobile Usage Information”). However, we do not ask you for, collect or track any geographic-location-based information from your mobile device (i.e., any information regarding where your mobile device is located on the globe at a particular time) at any time while downloading or using the mobile application of the Site. For clarity, this does not prevent us from asking you about your hometown location for purposes of completing your personal profile.

    We also use mobile analytics software to allow us to better understand the functionality of our Site on your phone. This software may record information such as how often you use the Site, the events that occur within the Site, aggregated usage information, performance data, and where the application was downloaded from; this information is considered Mobile Usage Information.

    Cookies are alphanumeric identifiers that we transfer to your computer or mobile device to enable our systems to recognize your computer or device and tell us how and when pages in our Site are visited and by how many people. Company cookies do not collect personal information, and we do not combine the general information collected through cookies with other personal information to tell us who you are or what your user name or email address is. Most browsers have an option for turning off the cookie feature, which will prevent your browser from accepting new cookies, as well as (depending on the sophistication of your browser software) allowing you to decide on acceptance of each new cookie in a variety of ways. We strongly recommend that you leave the cookies activated, however, because you may not be able to log in or use many of the Site’s most attractive features without cookies enabled.

    The Site may also contain electronic images known as web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how the Service is used.

WHAT DO WE USE YOUR INFORMATION FOR?

  1. Personal Information

    Generally, the personal information we gather from users enables us to personalize and improve our Service, and allows users to set up a user Account and profile through the Site. We also use personal information to respond to your requests for certain information and services, customize your experience on the Site, and communicate with you about the Service.

    Unless permitted by law, we only use personal information of users under 13 after obtaining parental consent. However, we may not request parental consent if we are using information obtained from a child to get parental consent. The personal information provided to us may be used in fulfillment of the Service. For example, when you use the Service, you may set up your personal profile, send videos and exchange messages with the individuals reviewing and providing analysis of the videos.

  2. Your email address

    We use email addresses to notify parents or guardians that their children have registered on our Site. We may also use your email address to communicate about your Account or in connection with our provision of the Service. We may contact parents/guardians about this Privacy Policy or our Terms of Use, or to obtain permission regarding use of their child’s personal information.

    If you provide us your email address, we may send you email communications. Web beacons may also be used in some of our emails to let us know which emails (and which links within those emails) have been opened by recipients.   3. Usage Information

    Company uses usage information to enable us to figure out how often users use parts of the Site, so that we can make the Service appealing and relevant to as many users as possible, and customize and improve the Service. We also use Mobile Usage Information to determine the device capabilities and usage trends which allows us to better understand which devices we should support and what features are most frequently used. As part of our use of information, we may provide aggregate information to our partners (in a non-personally-identifiable format) about how our users use our Site. We share this type of statistical data so that our partners also understand how often people use our partners’ services and the Service to help provide you with an optimal online experience.

  4. Push Notifications

    If you use the mobile application of the Site, we will send push notifications to your mobile device in order to make you aware of certain activities that may occur within your Account, such as when you have received a message. You may opt-out of receiving these types of communications by turning them off at the device level.

WILL COMPANY SHARE ANY OF THE PERSONAL INFORMATION IT RECEIVES?

Personal information about our users is an integral part of our business. We neither rent nor sell your personal information; we may share your personal information in personally identifiable form only as described below. We do not currently have any platforms that are designed to let children make their personal information publicly available.

  1. Vendors and Agents

    We will share personal information with vendors and agents who help us run our Site and provide the Service to you. For example, we share information with vendors who help us send emails and operate our Site and to the individuals who will review the videos you upload. We may also share information with vendors to complete payments or administer a promotion. Unless we tell you differently, Company’s vendors or agents do not have any right to use personal information we share with them beyond what is necessary to assist us.

  2. User Profiles and Coaches

    You may choose to populate your user profile on the Service with personal information, including, without limitation, your name, photograph, location, personal baseball statistics and videos of you performing baseball drills. Users who wish to receive personalized pitching, hitting and fielding instruction may send videos and exchange messages with the individuals reviewing and providing analysis of the videos (“Coaches”). We share personal information with Coaches only for the purpose of fulfillment of the Service.

    In limited instances, we may want to share personal information of users with our business partners or sponsors for marketing or other reasons related to your use of the Service. In such instances, we will not disclose any personal information until we first obtain the consent of the user’s parent/guardian, or if the user is 18 or older, the user’s consent.

  3. Protection of Company and Others

    We may release personal information when we believe in good faith that release is necessary to comply with the law (such as to comply with a subpoena); enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Company, our employees, our users, or others. We will try to give you notice if we release information for these reasons, but please understand that we reserve the right not to, as it may not be practical, legal, or safe to do so.

    In addition, we may share information with any successor to all or part of our company. For example, if part of our company is sold, we may provide user information as part of that transaction.

  4. Non-Personal Information

    We may share or disclose non-personally identifiable information with third parties for marketing and other purposes related to the fulfillment of the Service or maintaining security. For example, we may share the year you were born or the state you live in, but not your name or contact information.

IS INFORMATION ABOUT ME SECURE?

Accounts are protected by a password for your privacy and security. We also take steps to prevent attacks on our Site from web browsers and malicious scripts.

The Internet is not 100% secure. We cannot promise that your use of our Site will be completely safe. We encourage you to use caution when using the Internet. This includes not sharing your passwords. We keep personal information as long as it is necessary or relevant for the practices described in this Policy. We also keep information as otherwise required by law.

WHAT INFORMATION CAN I ACCESS?

We allow you to access personal information you have inputted or uploaded on your user profile page about you for the purpose of viewing, and in certain situations, updating or deleting that information.

WHAT OTHER CHOICES DO I HAVE?

You can always opt not to disclose information, even though it may be needed to take advantage of certain of our Site’s features.

We will retain your personal information for as long as your Account is active or as long as needed to provide you the Service. We also may retain and use your information as we deem it necessary to comply with our legal obligations, resolve disputes, and to enforce our agreements.

YOUR CALIFORNIA PRIVACY RIGHTS

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of personal information which we share with our affiliates or third parties for marketing purposes, and providing contact information for such affiliates or third parties. As stated in this Privacy Policy, we have adopted a policy of not disclosing a user’s personal information to third parties for direct marketing purposes unless the user first affirmatively agrees to the disclosure. CHANGES TO THIS PRIVACY POLICY

We may modify or update this Privacy Policy from time to time to reflect the changes in our business and practices, and so you should review this page periodically. When we change the policy in a material manner we will let you know and update the “Last Modified” date at bottom of this page.
